Agreement to Terms

Service Description

NightlySip is an email newsletter subscription service that delivers nightly emails on topics of your choosing. The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

User Accounts and Responsibilities

To use the Service, you must create an account. You agree to:

Subscriptions and Payments

Premium subscriptions are processed through Stripe. By subscribing, you agree to:

• Pay all fees associated with your subscription
• Provide accurate payment information
• Authorize automatic recurring billing
• Accept that fees are non-refundable except as required by law

We may change subscription pricing at any time. Price changes will apply to subsequent billing periods after notice is provided.

Subscriptions automatically renew unless canceled before the renewal date. You may cancel at any time through your account settings.

Intellectual Property Rights

All content, features, functionality, trademarks, and intellectual property rights in the Service are owned by NightlySip or its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal purposes only.

Email Content and Delivery

We curate and deliver email content based on your selected topics. We strive for accuracy and quality but do not guarantee:

• The accuracy or completeness of content
• Timely delivery of emails
• Uninterrupted service availability

You acknowledge that email delivery depends on third-party services and internet infrastructure beyond our control.

Data and Privacy

By using the Service, you consent to our collection and use of your data as described in our Privacy Policy. We handle your information securely and in accordance with applicable data protection laws.

Disclaimers and Limitations of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE PAST 12 MONTHS

Indemnification

You agree to indemnify and hold harmless NightlySip from any claims, liabilities, damages, or expenses arising from your use of the Service or violation of these Terms.

Termination

We may terminate or suspend your access to the Service immediately for breach of these Terms. Upon termination, your right to use the Service ceases immediately.

You may terminate your account at any time through your account settings.

Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law provisions. Any disputes shall be resolved in the appropriate courts.

Miscellaneous

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in effect. Our failure to enforce any right shall not constitute a waiver.
